BlazeRadar — Terms of Use

1. Agreement to these Terms

These Terms of Use ("Terms") are an agreement between you and Vibetronics LLC, a Georgia limited liability company ("Vibetronics," "we," "us"), with a business address at 1870 The Exchange SE, Ste 220 #580353, Atlanta, GA 30339. Vibetronics LLC is a subsidiary of Vibewright Labs LLC. By visiting blazeradar.org, using the live map, submitting the contact form, or installing and using the BlazeRadar mobile app (together, the "Service"), you agree to these Terms. Our Privacy Policy explains processing; it does not obtain analytics consent. Optional analytics starts only after a separate choice. If you do not agree to these Terms, do not use the Service.

2. What BlazeRadar is (and what it is not)

BlazeRadar is a wildfire-awareness tool. It aggregates publicly available wildfire-related information — such as fire incident data, hotspot detections, fire-weather alerts, smoke and air-quality data, drought conditions, shelter locations, and news — and displays it on a map and in feeds on our website. The mobile app is in development; app-specific licences and store terms apply only to a released app. We will publish release-specific data and permission disclosures before app collection begins.

BlazeRadar is not:

• an emergency alert or warning system;
• a substitute for official information from fire, emergency-management, health, or law-enforcement agencies;
• a monitoring service that watches conditions for you; or
• professional advice of any kind.

If there is ever a conflict between what BlazeRadar shows and what official authorities say, follow the authorities.

3. Emergency information disclaimer (full terms)

To the maximum extent permitted by law:

1. All wildfire, weather, air-quality, drought, evacuation, shelter, and related information in the Service is provided "AS IS" and "AS AVAILABLE," for informational purposes only.
2. We do not warrant that any information is accurate, complete, current, or available for any location, and we have no obligation to update it on any schedule.
3. The Service depends on third-party data sources, networks, and infrastructure we do not control. Data may be delayed, cached, interrupted, or wrong, and the Service may be unavailable exactly when you want it most.
4. You are solely responsible for your own safety decisions. Do not delay evacuating, ignore an official order, or take any safety-related action (or inaction) based on the Service.
5. In an emergency, call 911. Follow official evacuation orders and instructions from local authorities.

4. Data sources and attribution

BlazeRadar displays data derived from third-party and government sources, including:

• National Interagency Fire Center (NIFC) / WFIGS fire perimeters and incidents
• NOAA / National Weather Service alerts, forecasts, and weather data
• NOAA Hazard Mapping System smoke analyses
• EPA AirNow air-quality observations and forecasts (preliminary data, owned by federal, state, local, and tribal air agencies; not validated and not for regulatory use)
• U.S. Drought Monitor (NDMC / USDA / NOAA)
• Genasys / Zonehaven evacuation-zone data
• FEMA National Shelter System data
• InciWeb incident information
• NASA FIRMS satellite hotspot detections
• Wildfire-related news items from public feeds

These sources are independent of Vibetronics. Their data belongs to them or is in the public domain, is subject to their own terms, and its inclusion does not imply their endorsement of BlazeRadar. We do not alter the substance of their data, but we cache, reformat, filter implausible records, and combine it, which can introduce delay or error. The live map is rendered using Leaflet and OpenStreetMap base tiles. Map data © OpenStreetMap contributors, available under the Open Database License.

5. Eligibility and what you can submit

The Service does not offer user accounts. The only information you can submit is a message through the contact form (or by emailing us); the Privacy Policy explains how contact messages are handled. You must be at least 13 years old to use the Service. If you are below the age of legal majority where you live, use it with a parent or guardian who reviews these Terms with you. The Service is not directed at children under 13. No provision removes protections the law gives children or consumers.

6. License to use the Service

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the website and mobile app for your own informational, non-commercial use, subject to these Terms. The mobile app is licensed, not sold. App-store terms (Apple App Store, Google Play) also apply to app downloads, and those stores are not parties to these Terms.

API scope. Public API endpoints support the website and map. Their technical availability does not grant a separate bulk-download, third-party integration or commercial-service licence. Ask hello@blazeradar.org about intended use before integrating. Any separately permitted access must follow the agreed scope, published limits, attribution and applicable source licences. We do not offer a paid or commercial API arrangement through these Terms. Nothing here limits rights you independently have to government data or open-source materials obtained under their own terms.

7. Acceptable use

You agree not to:

1. use the Service in any way that endangers any person, or represent BlazeRadar data as official emergency information;
2. scrape, harvest, or bulk-download data from the Service or its APIs, or use automated means to access the Service beyond normal app/website use;
3. resell, redistribute, or offer the Service or its data feeds as your own product or service;
4. probe, disrupt, overload, or interfere with the Service, its servers, or its security (including rate limits and access controls);
5. reverse engineer, decompile, or modify the Service or app except where law permits despite this restriction;
6. misrepresent your affiliation with Vibetronics, BlazeRadar, or any emergency authority;
7. submit unlawful, deceptive, or abusive content through the contact form; or
8. use the Service to violate any law or the rights of others.

We may throttle, suspend, or block access that violates this section.

8. Intellectual property

The Service — including the BlazeRadar name and logo, the website, the app, our software, designs, and original content — is owned by Vibetronics LLC or its affiliates and licensors and is protected by intellectual-property laws. Third-party data displayed in the Service (Section 4) remains the property of its sources. Open-source components (e.g., Leaflet) remain under their own licenses. Nothing in these Terms transfers any ownership to you.

9. Feedback

If you send us ideas, suggestions, or bug reports (including through the contact form), you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. We will never owe you credit or payment for feedback, and you should not send us anything confidential. The Service has no user-content upload features; if any are ever added, these Terms will be amended first.

10. Disclaimers of warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

Without limiting the above: BlazeRadar is not an emergency alert system; we make no guarantee that any information is accurate, complete, or timely; always follow official evacuation orders and local authorities; in an emergency, call 911. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law:

1. Vibetronics LLC, its parent, affiliates, and their officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, property, profits, or goodwill, arising out of or related to the Service — including damages arising from reliance on wildfire, evacuation, air-quality, or safety information — even if we were advised of the possibility.
2. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amounts you paid us for the Service in the 12 months before the claim (currently $0 — the Service is free) or $100.
3. Nothing in these Terms limits liability that cannot be limited by law (including, where applicable, liability for gross negligence, willful misconduct, or personal injury to the extent such limits are unenforceable).

12. Indemnification

You agree to defend, indemnify, and hold harmless Vibetronics LLC, its parent, affiliates, and their officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Suspension and termination

We may suspend or terminate your access to the Service (including blocking API or form access) at any time, with or without notice, for any reason — including violation of these Terms or to protect the Service or its data sources. You may stop using the Service at any time; Sections 3, 4, 8–12, 14, and 15 survive termination.

14. Changes to the Service and to these Terms

BlazeRadar is an early-stage product. We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; if we make material changes, we will post the updated Terms with a new effective date and take reasonable steps to give notice (e.g., a notice on the website or in the app). Continued use after the effective date of updated Terms means you accept them.

15. Governing law, venue, and informal resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. Except where prohibited by law, any dispute not resolved informally must be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there. Before filing, both sides agree to try in good faith to resolve any dispute informally by contacting the other (Section 16) and allowing 30 days for resolution. These Terms do not contain an arbitration clause or class-action waiver.

Mandatory rights. These Terms, including liability, indemnity and venue clauses, do not exclude rights or remedies that applicable law does not allow us to exclude. Consumers retain mandatory local protections and access to courts available under that law.

17. Miscellaneous

• Entire agreement. These Terms govern use of the Service. The Privacy Policy explains processing; it does not replace any separately required consent.
• Severability. If any provision is unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries. These Terms create no rights in anyone other than you and us (except the indemnified parties in Section 12).
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control (including natural disasters — which, given what this Service is about, is a real possibility).
